Terms of Use

This document explains how you can use our services. Please read it before using them.

1. General

These Terms of Use (“Terms”) explain how you may use this website and all associated websites and services (“We”, “us”, “Website”, “Service Provider”, “DoKit” and its “Service” and “Services”).

You (the “Visitor”, “User” or “Account Holder”) should read this document before using this Website.

By accessing or using the Website you agree to be bound by these Terms of Use. If you do not agree with them or do not accept any of these terms, you should cease using this Website immediately.

1.1 Use of Service

By means of acceptance of the Terms, the User agrees to comply with the following rules:

  • To have read and understood the full contents of the Terms.
  • To have assumed all of the obligations and rights that are stated in the Terms and in the Privacy Policy.
  • To use the Service only for the purposed permitted by applicable laws, regulations, including with respect to copyright or trademark laws, export control, sanctions laws, or other laws in User’s and Service Provider jurisdictions.

As well as the following (“Prohibited Activities”):

  • Not to use the Service in a way that does violate the rights of any third-party.
  • Not to use the Service for any unlawful activity or any activity that violates terms and conditions of any third-party.
  • Not to gather, handle, or store personal information about other Users or third-parties.
  • Not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service.
  • Not to use information from the Service for spamming purposes.
  • Not to access or exploit the Service by scraping processes (including bots, scrapers, and spiders) and other automated and non-automated means.

1.2 Excessive Use

The Service’s bandwidth is limited and therefore the following apply:

  • If we determine your usage to be excessive we may temporarily throttle the Service for you.
  • If we determine your usage is significantly excessive we may temporarily disable the Service for you.
  • If we determine your usage is too excessive, to the extent that it is harming the performance of the Service to other Users, we may suspend the access to the Service for you.

1.3 Privacy and Confidentiality

All information and Content sent or uploaded by the User to the Service Provider is subject to Privacy Policy. On the top of the Privacy Policy, additional provisions described in 2.2 Confidentiality apply to the Content uploaded to perform the Service, but excluding personal information and information needed to create and maintain User’s account (as defined in 3. Accounts).

2. User Content

The User may create or upload content (“Content”, “User Content”) while using the Service. The User is solely responsible for the content and for any harm resulting from it. The Service Provider is not responsible for any public display or misuse of the Content.

2.1 Ownership

You retain all rights and ownership of the Content you upload to the Service. You guarantee that you own the rights to this content, and you take full liability for any damage caused in the event of a breach of copyright.

The Website does not claim any ownership rights to the content.

The User grants the Service Provider the right to store and process the Content as necessary to provide the Service and to improve the Service over time.

2.2 Confidentiality

The Service Provider considers the Content uploaded to the Service to be confidential and maintains the Content in confidence. The Service Provider take all reasonable precautions to prevent any unauthorized disclosure of the Content to any other Users or third parties, unless the User decide to publish the Content to other User or selected third-party.

2.3 Expiration of Content

User Content is automatically deleted after being processed, after specified time specific to the operation, described below. The Website does not analyse the Content of files uploaded by the User except for the scenarios described in 2.6 Service Access. User may choose to share a link to files uploaded to the Website to someone else.

The temporary nature of storage described above is to protect safety of the content uploaded to the Website while avoiding the loss of your data in case of short, temporary failure of Internet connection.

2.4 Removal of Content

Service Provider reserves the right to refuse or remove any Content that, in his sole discretion, violates any laws or the Terms, or any other Service Provider’s policy.

2.5 Manipulation of Content

The Service is designed to assist the User in processing files. It is the User’s responsibility to contact the Service Provider in case of any technical issues resulting in wrongly manipulated content. The Service Provider does not interfere with any individual Content beyond operations performed by automated software.

2.6 Service Access

The Service Provider reserve the right to access the Content uploaded by the User at some times. For example, to:

  • detect and prevent fraudulent or unlawful activities,
  • resolve technical issues and improve the Service,
  • or respond to support requests.

3. Accounts

An “Account” represents an individual User’s authorization to sign in to and use the Service on behalf of himself (individual person), a company, or an organization.

Parts of the functionalities of the Service are available without Account. The Service Provider may at any time and at his sole discretion restrict access to any functionality to selected type of Users.

The Service is available to the following type of Users:

  1. Visitor / Non-Registered (free, without Account)
  2. Registered User (free, with Account)
  3. Premium User (paid, with Account)

An Account can be accessed with credentials that should be kept confidential at all time by the User. The credentials include access to accounts in third-party services that are used as part of a single sign-on authorization method.

3.1 Account Requirements

For registration of an Account, and becoming a Registered User, it is required that:

  • That the User is a human, and is not a “bot”. Machine accounts are not allowed.
  • A single person or legal entity may maintain only one Account.
  • The User is of age 16 or older. When Service Provider learns that an Account is registered by a children under 16 it will be immediately deleted.
  • The credentials for an Account are not shared among a group of persons or legal entities.

3.2 Account Security

The User is responsible for keeping his Account credentials secure while using the Service. The Service Provider cannot and will not be liable for any loss or damage resulting from failure to keep the Account secure. The User is responsible for all activity that occurs under the Account. This applies as well when the activity is performed by an unauthorized person that gained access to your Account.

You will notify Service Provider every time you become aware of any unauthorized access to your Account or an Account of any other User.

3. Limitation of Liability

The Service Provider cannot and will not be liable to any User or any third party for any loss of profits, loss of data, or any other direct or indirect damages, that, inter alia, result from:

  • use or disclosure of User’s uploaded Content
  • use or inability to use the Service
  • modification, change of pricing, suspension, blockage of User’s Account or discontinuance of the Service
  • unauthorized access to or alterations of User’s transmissions or data
  • or any other matter relating to the Service.

Service Provider’s liability is limited irrespective to whether the Service Provider has been informed or not of the possibility of damages.

4. Paid Accounts

Some parts of the Service are billed on a subscription basis (“Subscription”). A User may choose to purchase a Subscription and become a Premium User. The Premium User has access to more functionalities listed on Pricing pages.

A Premium User will be billed in advance on a recurring and periodic basis (“Billing Cycle”). At the end of each Billing Cycle the Subscription will be automatically renewed under the exact same conditions.

4.1 Fees, Third-Party Fees and Taxes

The current pricing information (“Pricing”) can be found at https://dokit.org/pricing. All information presented in the Pricing are subject to change.

The new Pricing information will be sent to Users with Paid Account one month in advance. If the User does not accept the new Pricing information, the User can terminate the Subscription as described in 4.3 Refund and cancellation policy.

4.2 Payment Information

A valid payment method is required to process payment for the Subscription. Accurate and valid billing information, including details of a valid payment method, must be provided to the Service Provider.

All payment information must be kept up to date.

The order process is conducted by online reseller Paddle.com. Paddle.com is the Merchant of Record for all orders. Paddle provides all customer service inquiries and handles returns.

4.3 Refund and cancellation policy

Cancellation of the Subscription can be done at any time from the Account settings page. Alternatively, cancellation of the Subscription by the User can be done by contacting the Service Provider by email at contact@dokit.org.

The User have the right to cancel his Paid Account at any time. A cancelled Paid Account will not be refunded for the unused portion of the ongoing service period, except if the User requests a refund within 3 days of purchasing a Subscription (within the first service period for the Account).

No refunds will be considered for Paid Accounts deleted or terminated for violation of the Terms.

5. Choice of Law

Your relationship governed by these Terms of Use is with Fundacja Otwarte Państwo, with its office at Świeradowska St. 47, 02-662 Warsaw, Poland registered in the National Court Register under number KRS 0000924759, NIP 5213943254, REGON 520240316, and the Service is governed by the laws of Poland.

6. Changes to Terms

Service Provider reserves the right to change the Terms regarding the use of the Services at any time and to notify visitors by posting an updated version of this document on this website. If the User does not agree to these changes, he must stop using the Service. If the User does not stop using the Service then his use of the Service will continue under the changed terms.

7. Disclaimers

The Service (including all of its content) is provided to the User “as is”. The User uses this Website and the Services at his own risk. To the maximum extent permitted by applicable law, the Service Provider disclaims all warranties, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

The Service Provider makes no representations, warranties or guarantees that this site will be free from loss, destruction, damage, corruption, attack, viruses, interference, hacking, or other security intrusion, and the Service Provider disclaims any liability relating thereto.
